Bankruptcy
If your debt is out of control and you need a new start, you may want to consider declaring bankruptcy by filing an Assignment in Bankruptcy.
The actual bankruptcy process involves you working closely with a Trustee but before you get to that stage we can provide some assistance by:
Meeting with you to outline the process and discuss some alternatives
Negotiating new payment plans with creditors with a view to avoiding making an Assignment in Bankruptcy
Completing the paper work to make an Assignment in Bankruptcy
Navigating the process if you are served with a Petition for Bankruptcy by one of your creditors.
We can also assist on the other side. If you are a creditor and your debtor is insolvent and unable to pay the debt we can assist in drafting and filing a Petition for Bankruptcy and work with the debtors Trustee to collect payment of your debt.
Adult Guardianship and Trusteeship
If you need the power and responsibility to care for a loved one who cannot take care of themselves you may need an Order for Guardianship and Trusteeship. We can help you get the Order and help you navigate your new role. We can help take some of the weight off your shoulders by assisting with:
Applications
Inventories
Reviews
Litigation
Planning to optimize income and maximize government assistance
Personal Injury
If you have been in an accident and need someone to help you get restitution for your injuries we can help. We will work for you and ensure you get a fair settlement to help you recover and move on.
Independent Legal Advice
If you are about to sign a document that has not been prepared by a lawyer that you hired, or was prepared by a lawyer you hired jointly with the other side, you should probably get Independent Legal Advice (“ILA”). ILA gives the agreement more credibility and strength because it assures both sides there was no confusion, undue influence, or coercion.
At an ILA appointment we will sit down with you and explain the potential legal consequences of the document and give you our opinion. If you decide to go ahead with executing the document we will witness it for you and provide you with a Certificate of Independent Legal Advice.
Commissioner for Oaths
If you have to complete a document that requires a signature from a Commissioner for Oaths we can help. A Commissioner for Oaths is a person who is approved by the government to take oaths and solemn declarations which may be required to make your document official.
If you need a Commissioner for Oaths please contact our office to book an appointment. Please be sure to bring government issued ID to your appointment.
NOTE: You can fill out the forms on your own but do not sign them as you will be required to do that in front of the Commissioner for Oaths.
Notary Public
A document may need to be completed by, or in front of, a Notary Public to ensure that there as been no fraud and that the document is official. If your document says that it needs to be signed by a notary public please contact our office for an appointment. Please be sure to bring government issued ID.
As Notaries Public we can also provide Certified True Copies of documents. You can present a Certified True Copy of a document, such as a passport, to an authority as if it was the real document. Some application processes require notarized copies of documents. Please make an appointment with our office if you require a certified true copy and be sure to bring the original.
And More…
If you have a legal issue that isn’t in this list, please don’t hesitate to reach out anyway. We are always looking forward to learning about new and unique legal questions. The very least we can do for any issue is do some research or refer it to another lawyer who may have experience with that type of issue.
